Biden’s record the past year has been that of total failure. In mere weeks we went from energy independence and an energy exporter to energy dependence on others. With 9.6% inflation in 11 months, Americans lost 10% of the value of their money and inflation is now at a 40 year high. It is increasingly difficult to avoid the thought that the Democrats seek to destroy the economy and bring us into the Great Reset and world government. Our supply chain is falling apart and empty shelves prove it. Odds are, even the most incompetent person in government, would make a decision in our favor once in a while. On Biden we still wait.
Biden’s Food Chain Crisis
We no longer have a southern border and therefore not a secure country. Daily thousands invade us at will—from at least 125 countries of the world. Because of the Democrat’s Afghanistan debacle, Americans decry our leaving our own behind enemy lines and our allies have lost confidence in us—especially Israel and Taiwan. Our enemies do not fear Biden. Actually China nearly owns us. When was the last time you saw the label “made in America” on anything?
Biden’s vaccine mandates had to be declared unconstitutional by the Supreme Court before he, and his party, destroyed most of the Bill of Rights. The vaccines don’t prevent COVID infection or spread anywhere and a majority of the new infections are in those already double or triple vaccinated. Nor do his boosters or anything else he sought to force upon us.
Biden’s FBI now targets as domestic terrorists parents who confront school board mask policies or Critical Race Theory (white racism). This, on the direction of Biden to Attorney General Merrick Garland. Americans (63%) want parents to have the final say on what kids are taught.
The January 6th “insurrection” narrative is falling apart. Turns out it was led by unindicted government agents posing as Donald Trump supporters—a Deep State operation—and after a year not one person has been convicted of insurrection. A recent CBS poll shows no one believes the Jan. 6 hype. A whopping 76% believe that this was a protest that went too far—not an insurrection. This, while hundreds remain in The Washington D.C. Gulag as political prisoners in a state of indefinite detention, a violation of Constitutional Amendments 4-6 & 8.
Biden is rushing this country into fascism, world government and the Great Reset as fast as he can. In twelve months he, and his political party, have managed to make themselves the greatest internal threat in our history to liberty, the Constitution, and our republic. Biden’s approval rating, at 33%, is the lowest of any president in U.S. history, and Kamala Harris’s is even lower.
Americans no longer trust the mainstream media which most believe became the propaganda arm of the Democrat Party long before the 2016 presidential race and since. CNN viewership has collapse by 73% and the percentage change in news consumption habits for 2020-2021—the social media interaction with news articles—dropped 65%. People no longer are really engaging the fake reporting. Deep State censorship of almost everything negative to the election, the pandemic, and Biden Jr. and Sr. China connections, amplified the peoples’ distain for this man and his government.
The people now know that everything the Deep State (Democrat) press called conspiracy theories is instead the truth. This is what happens when 97% of the media is controlled by corporations. These include coverage on: Nicholas Sandmann, Jussie Smollett, Kyle Rittenhouse, Russian Collusion, The Steele dossier, kids in cages, hydroxychoriquin and Ivermectin as known COVID cures, a politicalized border wall and pandemic, even, it appears, Biden’s fraudulent election. Everything they said about these people or issues was fake, phony, and false.
America is no longer with Joe Biden and most now believe his “election” was fraudulent. Democrats have nothing to run on in 2022, except the same thing they used since 2016, “We hate Trump and so should you!!” But that gig is over! Almost no one reveres Biden. If the presidential election were held today Trump would win all five battleground states.
So how does this translate to “the people are winning?” What I have just written most Americans now believe—but didn’t a year ago. This despite the massive censorship and fake press. The people had to be shown. Had Trump not vacated the White House, he would have remained the only target with virtually all the media against him. Let him effectively disappear for a short while. Let the Democrats and Biden occupy the White House, feel in charge, and let the Deep State, the invisible government, expose themselves as has happened the past year.
Everything is now in the open even despite media control and severe censorship: election fraud, open borders, CRT, open war on the Constitution especially The Bill of Rights, destruction of the economy, vaccine crimes against children and humanity, the China connection with both Biden Jr. and Sr, the successful coup of November 3, 2020—even treason. Durham will continue dripping out indictments on both the Clintons and possibly Barack Obama, and Ghislaine Maxwell will yet “sing” on many high profile politicians. The Industrial Pharma Complex will come into light. States will continue dripping out serious election fraud and decertifications will follow. This is all part of Devolution. The people are awakening, thus winning.
Trump asked August 13, 2021, “DO YOU MISS ME YET?” Put simply: liberty misses you, the Constitution misses you, the economy—our savings and food supply chain—miss you, our borders miss you, our allies—especially Israel and Taiwan—miss you, and those who do not want world government miss you. Under Democrat governors and a socialist president, we have seen what tyranny looks like and we abhor it. President Trump, most of us welcome and await you.

In 2021 we viewed televised school board meetings with parents demanding their boards allow students to take off the masks. One eight-year-old girl in particular, Fiona Lashells, having been expelled 36 times for not wearing the mask, told school board members, “In closing, I hope everyone doing this to me goes to jail, thank you” (“Fiona Lashells missed two months of school for refusing to wear a mask,” Palm Beach Post, Andrew Marra, Nov. 15, 2021).
She was far closer to the solution than anyone could imagine as we will show. Amazingly, her school board changed the mask policy. But most don’t, and it has nothing to do with health or safety—try “free” COVID money.
When confronted most board members appeared trance-like in their response as though they knew more than the parents—a secret even. They did!! Their districts were receiving millions from the Biden Administration to hold firm on all Democrat COVID mandates (decrees).
There is not a single peer reviewed study that shows masking stops viruses. The COVID virus is one micron, a cloth mask is 80 microns between threads. None of the “diapers” (face coverings), —including N95, stop viruses. Most who wear masks today are not well informed.
Only a hazmat suit has any hope of stopping a virus and that is what caused AJ Depriest, a healthcare policy analyst expert to offer a compelling unanswered question. “Why, if COVID is so deadly and masks are so necessary, why aren’t there any OSHA regulated hazmat bins in schools? Something’s up with this. It can’t be about health and safety like they’re telling us” (“AJ Depriest Uncovers the Enormous COVID Bribes to all Education and Hospitals from the US Government,” Bit Chute, Interview with Del Bigtree, the Highwire.com, January 8, 2022).
She and 25 others, on June 9, 2021, formed The Tennessee Liberty Network, to study the Cares Act (Coronavirus Aid, Relief, and Economic Security Act), a $2.2 trillion economic stimulus bill signed into law March 27, 2020, primarily the $13.2 billion earmarked under (Elementary and Secondary School Emergency Relief) money and how it was distributed and managed. They did the same respecting the ARP (American Rescue Plan Act), another COVID spending bill of $1.9 trillion signed by Joe Biden, March 11, 2021.
To date says AJ Depriest, “Schools have been given almost $200 billion of relief money.” What are the Democrats buying with all this money? Mostly the compliance of our defenseless children to their unconstitutional and unlawful COVID decrees. The federal government is waving billions of dollars in front of these boards as obedience bribes.
To get this money schools must implement the following Democrat agenda: “universal and correct wearing of masks, physical distancing, hand washing, cleaning, ventilation, contact tracing, quarantine isolation, and, the second to last on the list, is vaccinations. This is why they’re getting the money. It has nothing to do with health and safety.” And, “every state is doing it.”
None of these functions are listed in Article I, Section 8 of the Constitution as federal powers thus they belong to the states as per Amendment 10. Congress has no authority to fund what it has no power to legislate. Because they can’t make these laws they instead give bribe money to accomplish the same thing and unscrupulous school boards lineup with alms bowls in hand.
Del Bigtree, monitor of the interview, summed it well. “So when we’re standing there as parents at the school board meetings and say ‘Get the mask off my kid, they’re getting rashes on their face, my kids depressed. They haven’t seen their teachers smile. they’re not interacting socially, I see them failing.’ We just see those blank stares because that school board knows—I’m not going to turn down—What is it, $10 or $15 million to listen to you?”
AJ. Depress broke in, “Much more than that.” In Tennessee “Shelby County gets almost three quarters of a billion dollars in COVID relief funds for education to the schools …. Nashville Public Schools is half a billion dollars in COVID relief funds.”
Apparently to get the handout (bribe) school districts must apply and thereafter, every six months, file documents proving their compliance through September 2023. They must prove how they are fulfilling these requirements “for all students, staff and teachers.” Can we comprehend the stress these mandates lay on children? How do you force them, or even staff and teachers, to do contact tracing and vaccinations without serious breaches of the Constitution? Mandates are not laws therefore are unenforcible and totally unconstitutional.
Del Bigtree added, “Billions literally billions of dollars are being funded to imprison your child, to socially distance them, to shut down the school, or make them wear masks. All of that is being funded against you by your President, by our administration.”
So what does AJ. Depress, and her Network, suggest parents do to resist this medical tyranny? First find out how much money they are receiving “to commit this, this egregious tyrannical behavior on our kids, and if they don’t know tell them how much it is and tell them to give that money back.” The Network, she offers, will “point you in the direction to find this information.”
It is not likely that little Fiona will get her wish that “everyone doing this to me goes to jail,” but boards are elected to reflect the will of their constituents—not their own—and not the agenda of the Democratic Party through bribe money. Some school boards have put money in front of honor and their responsibility; all on the backs of the children they abuse.

Never interfere with a party in the process of destroying itself. In 2021 the Democrats, even with favorable press, did not need an opposition party to accomplice this. We note some examples.
Abandoning Americans in Afghanistan to the Taliban destroyed the world’s confidence in America’s historic promise that they could count on America to help shield them from tyrannical governments. Moreover, Americans who travel broadly knew that it could have been them caught and abandoned behind enemy lines by their own government. Leaving behind, so callously, Afghans who had shed blood with and for us for twenty years, did not set well with most Americans. Getting out of Afghanistan and the war had support but not the cowardly way we did, leaving $90 billion of weaponry in enemy hands. The military know that they may have to face the weapons this administration so incompetently left behind.
Most Americans do not approve of Biden’s handling of the Southern border crisis either. Kamala Harris, whom Biden called on to bale out his unpopular opening of the United States to the world and every criminal in it, only amplified the image that Democrats did not care about Americans living here. By Oct. 25, 2021 the administrations’ approval rating had fallen to 36%.
The Democrats answer to the COVID “Pandemic” was always medical tyranny. You may have your freedom: when: everyone is locked down for months, when everyone is forced to wear a mask, then two masks, when all distance six feet from others, when all get a mandated (forced) experimental “vaccine,” and when vaccines don’t work, then mandated boosters every four months. Even now California and Washington D.C. have returned to mandatory masking. This when they could not document that ANY OF THESE MEASURES SAVED A SINGLE LIFE but were instead destroying businesses, the economy, education, the Constitution and freedom.
Too few Democrats recognized the threat to freedom so they accelerated its loss. Their news still censors the fact that more people died with COVID during 2021 under Biden leadership, than 2020 under Trump. And, Free states had less COVID infection and death than non-free states. Even now, New York Congresswoman Alexandria Ocasio-Cortez is condemning Florida for not locking down its people while she is filmed enjoying its beaches and freedom without a mask.
With censorship protecting tyranny, fans at sporting events began spontaneously erupting into chants, “F Joe Bidden, F Joe Biden,” demonstrating their utter contempt for the man and his party. Such a chant had never been used by crowds in American history. By this time 61% of Americans believed that the country had seriously gotten off on the wrong track. Asked if the above expletive chant was appropriate 59% said that it was (X22 Reports, Ep. 2112B, Oct. 27, 2021). This, while the Democrat news outlets and Big Tech praised Biden and censored opposing information of him and their party.
The expletive chant was soon changed by the unappreciating controlling press to “Lets Go Brandon,” weakening the power of the original vile meaning, although still derogatory. President Trump said he liked the original one better; likely those first uttering it do as well.
Meanwhile a “We Love Trump” chant spontaneously erupted in the Virginal governor’s race between former Democratic Gov. Terry McAuliffe and Republican Glenn Yongkin (X22 Reports, Ep. 2612B—October 27, 2021). The same chant had erupted at least three times while Trump was on the campaign trail in 2020 (“‘We Love You,’ Chant Breaks Out at Trump Rallies,” LibertyUnderFire, September 25, 2020). Obviously such extreme polar opposite chants “F Joe Biden” or “We love you” were unlikely ever previously used by large crowds in U.S. history.
Under Biden every American, rich or poor, lost nearly 10% of his money.
A November Rasmunson Report, published by USA Today, asked poll takers, “What is the one thing you want Biden to do this year? The popular answer, “Resign.”(X22 Reports, Ep. 2623B, Nov. 9, 2021). A month later a national poll reported that only 22% of Americans wanted Biden to run again (X22 Reports, Ep. 26455, Dec 6, 2021).
By this time U.S. productivity declined by 5.2% in the 3d Quarter—the largest quarterly drop in 61 years” (X22 Reports, Ep. 2649A, Dec. 10. 2021). This while the US. Consumer price inflation jumped to 9.6% over the previous November—the largest one year increase ever. Consequently consumer prices soured: gasoline 58%, Rental cars 37%, used cars 31%, hotels 26%, steak 25%, utilities 25%, bacon 21%, pork 17%, furniture 12%, fish 11%, new cars 11%, chicken 9%, bikes 9%, eggs 8%, coffee 7.5%, apples 7%, milk 7%, flour 6%, rent 3.5%. Under Trump 2018 inflation was 2.2% and 2019 was 2.5% ((X22 Reports, Ep. 2652A, Dec 14, 2021).
Under Biden every American, rich or poor, lost almost 10% of the value of all his money the last eleven months. If Trump had done this to the American people there would be 24/7 coverage of it. Because there isn’t you know the media is complacent in it,
Paper currency is losing value before we can spend it. Since 1913 the value of the dollar has declined 96% (X22 Reports, Ep.2649A, Dec. 10, 2021). In fairness this is due to both political parties, neither able to say no to debt ceilings and selling their votes. “Seventy seven percent say inflation is America’s biggest problem, a bigger problem than COVID; of these 57% blame Biden” (X22 Reports, Ep.2650A, Dec. 12, 2021). This after but one year in office.
By the end of 2021 The Rasmussen Reports daily Presidential Tracking Poll showed that only “40% of Likely U.S. Voters approve of President Biden’s job performance. Fifty-eight percent (58%) disapprove. The latest figures include 19% who Strongly Approve of the job Biden is doing and 48% who Strongly Disapprove.”
Again, “Never interfere with a party in the process of destroying itself.” Trump Republicans aren’t. The day will come when no Democrat will readily admit having once been one.

For decades I read in my college classes messages smuggled out of socialist / communist prisons in Romania, Cuba, North Vietnam, the USSR, Communist China, North Korea and etc. some no worse than now coming out of the District of Columbia Department of Corrections in the United States. American citizens have been thrown into cells, denied family visits, fed horrible food, and imprisoned in essentially solitary confinement for up to 24 hours daily.
Approximately 650 January 6 Rally participants were “later charged and arrested in raids that involved armored military vehicles and SWAT teams.” Many of these thereafter were detained for most of a year without trial on Nancy Pelosi’s and the Democrat Party media outlets’ supposition of insurrection. Still, not one has been charged with insurrection!! Evidence of insurrection does not exist or this would have been charged. Confinement and tortuous treatment is largely punishment for their support of Trump in the Electoral College vote count.
They are instead American political prisoners. Those able to get messages “out to the public tell of their long-term solitary confinement without cause, sleep deprivation techniques, beatings at the hands of guards while in restraints, and threats of harsher treatment for speaking to the media (“Ignore the Dissidents of Our Time at Your Peril,” by Sarah Corridor, Homefront Crusade, October 13, 2021). All, dissident punishment techniques of communist countries cited above.
I had never supposed that I would see the same in the United States—political prisoners. But I also never supposed that socialists would take over this country implementing censorship, lock-downs, and mandates as in communist regimes. Washington D.C. is governed by the House of Representatives, presently led by Nancy Pelosi as speaker. None of this could happen without her knowledge and consent.
What follows is one of those letters smuggled out. Its author Nathan Degraves has no unlawful or violent history. He did not break anything nor hurt anyone.

“Dear fellow Americans, I never thought I’d write a letter like this but we’re living in very different times. This is my cry for help. My name is Nathan Degraves. And as a non violent participate at the January 6 Rally I’ve spent the last nine months detained as a political prisoner in pod C at the DC Department of Corrections, otherwise known as DC’s Gitmo.
“The conditions here for January Sixers have been inhumane. In fact, some inmates are even begging to be transferred to Guantanamo Bay, where they have more acceptable standards. Class action lawsuits are being filed against this prison and even the ACLU has gotten involved.
“So let me tell you about me and many others who are January Sixers and what we’ve been experiencing in DC’s Gitmo, our conditions for the last 120 days. For DC’s Gitmo January Sixers experienced daily lockdowns for 23 to 24 hours before being allowed to leave our small 120 square foot cell. The physical and mental anguish that results from this kind of severe isolation has caused many people to go on a rapid mental decline. As a result, a large percentage of us are heavily medicated with anti anxiety and anti depressant drugs, which helps to cope with the psychological and mental abuse we endure. Many times the little recreation we do receive is stripped away if our cell isn’t up to standards of the guard on duty. This changes from day to day.
“January Sixers have lost recreation time, and out of cell activity time, for any news interviews about the jail when they are aired on TV, when people speak up about our conditions or rallies are held in our name. We’ll probably have a lock-down upon the publishing of this letter. So I have already warned those I know in advance.
“I suffer headaches and nausea. I have already lost 15 pounds since I’ve been detained and I was quite thin and fit to begin with. After in person visits, legal or otherwise we are forced to undergo humiliating strip searches despite all visitors being thoroughly checked for contraband. If it’s an illegal visit we are placed in a 14 day quarantine with no out of cell time even if your attorney is vaccinated and tests negative for COVID. Visits with friends or family members for unvaccinated inmates are never allowed.
“I am being unfairly prosecuted and definitely overcharged. I never assaulted anyone destroyed property or stolen anything. Please don’t be fooled by the media. I am a loving and peaceful person with no history of violence.
“Please share this letter with everyone you know friends and family, senators, representatives, political organizations, organizers, civil rights groups and media outlets. The truth has to get out and the jail must pay for what they are doing to this country’s citizens. The government has essentially cancelled me.”

All America must unite in condemning censorship and tyranny. If the government can do this to one philosophy, political party, or person it can do it to anyone. The government has nothing on Nathaniel Degrave or they would have produced it long ago. They must assume his legal fees, pay compensation for his incarceration, and set him free immediately. As a college professor for forty years, I instructed the Constitution and Current Events and still teach both in LibertyUnderFire.com columns on line such as this one. I know the Constitution worked well for every situation this nation confronted in those 40 years. My current events classes began. “You are not Democrats or Republicans, you are constitutionalists.” “Every issue presented here will be debated and resolved with this document.” When applied as written it has never failed us and students learned how to use and love it.
The following parts of the Constitution when followed, demonstrate why tyranny can never gain hold in the United States and why the Constitution remains its principle antidote. Follow along with your own copy of the Constitution.
Every single law must be initiated and passed by elected members of Congress—the Legislature. After signed into law the executive and judicial branches were given power only to act on existing law, one to administer the other to adjudicate.
Lawmakers initially had limited time to make law. Congress assembled on the first Monday in December (Article I, Section 4 ) and our Christian founders wanted to be home for Christmas, December 25. Getting home in time, in a horse and buggy day, gave them less than three weeks to make law. Such limited time was practiced until changed by the 20th Amendment ratified Jan. 23, 1933, when Franklin D. Roosevelt wanted the federal government to meet continually.
Lawmakers must adhere to a list in making law, not just make it up (Article I, Section 8). Today neither political party pay any attention to this list. The list gives them only four areas from which to make law: taxes, paying debts, provide for the common defense, and general welfare of the United States. The remainder of this, originally one long sentence of 17 paragraphs, were qualifiers on these last two powers, common defense and general welfare so that these were further restricted. The Founders had no intention of leaving these broad phrases unspecified.
The Federal government was limited in the amount of property it could hold to just 10 square miles for a capital and only land for military purposes which must be purchased and approved by the state legislatures from which taken (Article I, Section 8, Clause 17). Today federal land encompasses about a third of the U.S., this without any approval other than their own.
Presidents must adhere to a list of areas where they can execute the law found in Article II, Sections 2 and 3. There never was, nor is there today, constitutional language authorizing presidents to make law, executive orders, decrees or mandates. Nor can they combine ancient pieces of law to create a new law. Initially executive orders were interdepartmental directives.
The Supreme Court must adhere to a list of areas where they can adjudicate the law and be in compliance with two types of adjudication—original and appellate (Article III, Section 2). There exists no constitutional language authorizing ruling in such a way as to create new law as that belongs to the legislative branch alone. Nor does any language exist enabling them to undermine or destroy federalism. Remember the states created the Constitution. Housed permanently within it is shared government or federalism (See Article V and Amendment 10).
The Constitution allows change to it but only through 3/4ths vote consent of the states (federalism)—no exceptions (Article V). This is why enemies of the Republic despise it. They can’t go through it, around it, or over it. They tried. The Constitution also has no language allowing any authority to be passed to a higher government than itself such as the United Nations. Globalists have wanted world government since Woodrow Wilson’s League of Nations.
States would not ratify the Constitution without a specific list of things the government could not do to them, a Bill of Rights, arranged in order of their preference—“thou shalt nots.” These include Amendment I the expression rights: religion, speech, press, and assembly specifically were denied governmental control. Amendment II was especially important as it included the right of revolution, the same authority they used to revolt against British tyranny. This could not be denied their posterity should government tyranny again prevail. “The right of the people to keep and bear arms,” was made nonnegotiable, by “shall not be infringed.”
The first three words of the Constitution were “We the People,” Amendment 9 wanted it understood that any “enumeration in the Constitution, of certain rights,” of the people could never mean that these alone were their rights. It would always be “We the People.”
But Amendment 10 is today probably the most important sentence in the Bill of Rights and in the Constitution as it places the states between the individual and the federal government to protect him/her from federal tyranny. It established federalism as the heart and protector of the Constitution. It defined how the entire Constitution is to be interpreted. “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” But today it is one of the least applied sentences.
Finally, every office holder federal, state and local is required to give an oath of allegiance to the Constitution. From the president down to every person employed in the armed services it is in substance similar to the following for the president: “I do solemnly swear … that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United State.”
For these reasons tyranny can never prevail in America with the Constitution as written. But when it is shredded, as is happening, tyranny will reap through American like a whirlwind.

These are unprecedented times. No president has intentionally failed to protect this country from invasion until now. Previous to this time all political parties, would have supported impeachment to rid themselves of this major threat to national security.
The Joe Biden Administration pretend there is no border crisis as a million and a half unvetted invaders coming from at least 150 countries have illegally crossed into the United States during his time in office. Biden has never been on the border and shows no interest in upholding any of the long established laws regarding it while narcotics and sex traffickers flow freely through. Presently Florida is suing Biden for human trafficking as his administration purposely flies or buses illegals into our cities nation wide.
All this on a border that was more secure under the Trump Administration, largely by building a wall, than at any time in our history. Even now we know of 60,000 illegals, mostly Haitians, approaching our border to overwhelm our border patrol and invade our states, counties, and cities. This would be the second Haitian invasion in six weeks and the Biden Administration has no announced plans to deter them, and in fact by negligence, he encourages their coming.
Does the Constitution allow this? No!! Article IV, Section 4 specifically guarantees each state protection “against invasion.” When taking office the president swears by oath “to preserve, protect and defend the Constitution of the United States” (Article II, Section I, Clause 8). His primary function is to execute the laws passed by Congress: “He shall take Care that the Laws be faithfully executed” (Article II, Section III). He refuses! His administration is the greatest threat to the Constitution in U.S. History.
What is the countries recourse when its chief executor openly defies established immigration laws, engages in human trafficking of illegals into the interior, and refuses the primary duty of his office to protect the nation? An unsecured border is America’s biggest national threat. The answer is not to wait three plus years for another “fraudulent” election, there will be no America left to save. Nor is it the 25th Amendment as Kamala Harris appears no more fit for the office than Biden—especially on the subject of illegal immigration. Nor is it Impeachment as the House of Representatives, led by Speaker Nancy Pelosi, constitutionally charged with initiating this process will defy this part of the Constitution as well.
Until one of these options is activated removing him, the only remaining constitutional option and answer is that the states must secure their own borders. Remember, under federalism, implemented with the Constitution, we operate under two co-equal governments federal and state; the federal to govern primarily foreign policy, the state entirely internal interests. Should the federal government refuse to protect the border, an open border translates into a state issue one foot inside.
Arguably a state, with Biden opposition, cannot order federal agencies to protect it from an invasion, but it can use the state militia without his authority. The militia is not the army. It is the people, the citizens, and in the 2nd Continental Congress, even before the Constitution, the militia was defined as every able bodied male 17 years of age and older.
In 1903 the Dick Act clarified the 2nd Amendment definition of militia by dividing it into Part A, the unorganized militia, “the right of the people to keep and bear Arms shall not be infringed,” and Part B, “a well regulated Militia,” the National Guard. Both “being necessary to the security of a free State.” The organized militia was to remain a separate body from the army and navy and retain its distinct internal function and control under the state legislatures and governors (when they could not be convened) “against domestic violence” (Article IV Section 4). Notice the wording in the Constitution authorizing Congress, “to provide for calling for the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions”—all internal functions (Article I, Section 8, Clause 15). Congress and state legislatures can call it forth.
Unlike the army the militia is allowed to execute the laws of the union, suppress insurrections including, with state authorization, domestic violence . The Posse Comitatus Act forbids the military these internal functions.
The National Guard was never to be thought of as merely a pool of reserve troops for the army. Impeachment proceedings should have been threatened against President George W. Bush when he treated them as such deploying 100,000 of them in 2005 to Iraq and Afghanistan, when enlistments were not enough, rather than asking Congress to restore the draft. This alteration of the Constitution by blatant ignorance is serious. The National Guard was simply an easy target and no one from either party objected. But it cannot perform its constitutional duty outside the United States. President Barack Obama ordered one-year deployments of Guardsmen in Afghanistan in 2014. Both parties have violated this part of the Constitution.
The rational for a militia separate from the army is very simple. The first line of defense from unwanted aggression is oneself (2nd Amendment), followed by local law enforcement agents, followed by the National Guard guarding the nation from within (2nd Amendment), followed by the military. Biden, by unconstitutionally flying or busing illegals into the interior rather than vetting them fully in Mexico, should motivate all state legislatures to send their Guardsmen to the border immediately. Placing them on the border to repel the coming Haitian invasion would be entirely constitutional. It would also help discourage future invasions.
